Archives for category: transactions

In follow-up to my terrific trip to the 2011 AWRA meeting, I made some observations of the people of water (highlighted above). Personally, I like them all. For what appears to be a relatively simple substance, the polarity and conflicting human views associated with water make it an intriguing market.

The characterizations highlighted above are by no means exhaustive and, obviously, my opinion. Just consider them the people of WATER part one. Feel free to share ideas or suggestions for part two.

Transactions costs represent a significant expense in water deals. Minimizing these expenses should remain a primary focus. Water right transaction costs tend to be smaller for:

1)larger transactions (on a per acre-foot basis)
2)transactions with less opposition (objectors)
3)more senior water rights
4)deals where the conveyance structures are not shared by multiple users
5)adjudicated water rights or water rights with documented historic use
6)water rights with few competing users
7)states with efficient regulatory review processes- this is a big one.
